Thank you for visiting our website at www.yourmoto.bike, (the "Site") we want you to know that we really appreciate your business and loyalty, and want to make sure that you are happy with your online shopping experience with us at all times.

This document, together with the documents referred to in it, gives you the legal terms and conditions (the “Terms”) on which you may use the Site, and how we sell our products (the “Products”) to our customers.

You should be aware that we may change these Terms and Conditions from time to time, so please review them each time that you visit the Site. You should retain a copy of these Terms for your future reference, and ultimately, your protection. 

If you disagree with any of the terms and conditions of this agreement, then we would advise you to leave the site immediately.

The Terms set out in this document apply to any contract (the “Contract”) between us, YourMoto.Bike Limited (the “Company”), and you, the customer. You should read and understand these Terms prior to making any order request on the Site. By agreeing to order from this Site, you are agreeing to be bound by these Terms and other documents referred to in it.

These Terms, and any subsequent Contract between us, are only available in the English language.

Information About Our Products

All of the Products shown on our Site are subject to availability, and we will inform you as soon as possible if a Product you have ordered is unavailable at that time. We will not process your order for an unavailable Product if the order is made.

All images on our Site are for illustrative purposes only, and although every effort is made to represent the colours accurately, we are unable to guarantee that your computer’s display will display such colours accurately. Your Product may vary slightly from the images displayed.

The packaging that we use for the Products sold on our Site may differ slightly from images displayed on our Site.

We make every effort to be as accurate as possible with all sizes, dimensions, weights, capacities and measurements, but you should be aware that there is a 2% tolerance in all of these figures quoted on our Site.

Submitting Personal Data & User Communications

When you register an account with YourMoto.Bike, we request personal information from you in order to safely and securely complete the process. Any personal data or feedback that you provide via our Site cannot be guaranteed against inception by a third party while in transit over the public internet. Your data will, however, always be governed by our Privacy Policy once it has been received. Our Privacy Policy can be viewed here.

For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide electronically satisfy any legal requirement that such communications be in writing.

Consumer Protection

The consumer has legal rights in relation to any Products that are received faulty or not as described on our Site. You can seek advice about your legal rights from your local Citizen’s Advice Bureau or any Trading Standards Office. Your legal rights as a consumer are not affected by these Terms.

You are not permitted to make a purchase of any Product on our Site unless you are at least 18 years of age.

Our Contract With You

When you order a Product or Products from us, the order process allows you to check for any errors prior to submission. You should check your order at each stage of the checkout process. Once an order has been placed, you will receive an automatic email notification from YourMoto.Bike acknowledging that we are in receipt of your request. This is not acceptance of the order yet.

Our acceptance of your order will follow in a separate email and this forms our Contract with you. If we cannot provide you with the Product in your order, this will be confirmed by a further email notification and we will not proceed with processing your order. If you have made a payment for your Product, we will refund your money as soon as possible.

Whenever we refer to "In Writing" in these Terms, this includes our electronic communications as well.

We will not file a copy of the Contract between us.

Payment

To complete your ordering process, you are required to make full payment of the Product price and quoted delivery charges in advance of delivery of your order. You may only make payment to us using a debit or credit card or via PayPal. We only accept the following cards: Visa, Visa Debit, MasterCard, Maestro or Solo.

Pricing

Whilst we take reasonable care at all times to make sure that the prices that appear on our Site are accurate at the time of entry, there may be an occasion that an error in the pricing of Product(s) has been made. Should you make an order of a Product that we discover to be incorrectly priced, we will inform you of this error as soon as possible and give you the option to continue with the purchase of the Product at the correct price, or to cancel the order if you are not happy with the correct price. Please note that the order will not be processed should we inform you of an incorrect price, until we receive your instructions on how you would like to proceed. Should we be unable to contact you using the details you provided as part of the ordering process, we will cancel the order and notify you in writing.

Please note that if the pricing error is unmistakeable and could have reasonably been recognised by you as an error, we do not have to provide the Product(s) to you at the incorrect (lower) price.

The prices of our Products can be subject to change over time, but any changes that we apply to Product(s) do not affect any order you may have placed that has been confirmed by our official Order Confirmation. The price of a Product includes value added tax (VAT) where applicable at the current rate chargeable in the UK at that time. Should the current applied rate of VAT change between the date of your order and the date of delivery, we will adjust the VAT you have to pay, unless you have already paid for the Product(s) in full before the change in the applied VAT rate take effect.

The quoted price of one of our Product(s) does not allow for delivery charges unless otherwise stated on our Site. Our delivery charges are as quoted at the time of placing your order. To check relevant delivery charges, please refer to your Order Confirmation email that you receive as part of ordering process.

Price Match Promise At YourMoto.Bike

We offer a price match promise whereby if you find any of our Products elsewhere in an identical format and the price including delivery charges is lower than that displayed on our Site, then, subject to availability, we will endeavour to match the price you have found elsewhere.

To take advantage of our Price Match Promise offer, you must be able to send us the link to where you have found the Product for sale at a lower price than on our Site prior to your purchase with us, or within seven days of making your purchase on our Site. This offer may be withdrawn at any time by us, and is put in to place to ensure fair trading at all times.

If we feel that the offer is being mistreated, it will not be honoured. Please note that we are only able to match prices of UK sellers, and we will not match a price in conjunction with any other offer.

Our Price Match Promise does not include private sellers on classified sites.

Acceptance of our Terms and Conditions (“Terms”)

If you visit our website and complete a purchase from our online catalogue, you are acknowledging that you have read and agree to be bound by the Terms & Conditions that appear in this document and others referred to in it. You are deemed to have entered in to an agreement with YourMoto.Bike Limited at this point.

In addition, acceptance of these terms and conditions include acceptance any competition or promotional terms and conditions stated on our website. These can be found via a link at the bottom of our homepage.

We are entitled to update, change or replace all or any part of these Terms & Conditions at any time, and it is the responsibility of you, the customer, to check these pages periodically for such amendments. Should you continue to use our website to make a purchase after the Terms & Conditions have been amended, then this constitutes your acceptance of these changes.

Any update or change in the Terms & Conditions will be notified by a change in the date at the top of this page.

Our Liability With You

On the rare occasion that we fail to comply with these Terms established here, we are solely responsible for loss or damage you may suffer that is a direct result of our breach of our Terms or our negligence. Note, however, that we are not responsible for any loss or damage that is not a direct or foreseeable result of this breach. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into the Contract.

To the extent that is permitted by law, we do not accept any liability for failure or fault in any Products that are a result of your modification of such Products in any way.

Our Products are only supplied for domestic or private use and by entering in to a Contract with YourMoto.Bike by completing your purchase, you are agreeing not to use the Product for any commercial or re-sale function. We will have no liability to you for any business losses brought about by improper use of our Products supplied to you.

We do not in any way exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, defective products under the Consumer Protection Act 1987, any breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession), or any breach of the terms implied by section 13 to 15 of the Sale of Goods Act 1979 (description, satisfactory quality, fitness for purpose and samples).

Events Outside of our Control

An Event Outside of our Control means an occurrence or event that is beyond our reasonable control, including without limitation floods, earthquakes, storms, fires, explosions, riots, terrorist attacks or threat of terrorist attacks, invasions, wars (declared or not) or threat or preparation for war, strikes or other industrial actions by third parties, civil commotions, subsidence, epidemics or other natural disasters, impossible use of public and private transport networks (railways, shipping, aircraft, motor), or the failure of telecommunications networks (public or private).

You should note that we will not be held liable or responsible for any failure or under performance on our part, of our obligations under our Contract that is brought about by an Event Outside of our Control (as defined above). Should your order become affected by such an event then we will contact you as soon as reasonably possible to inform you what has happened, and our obligations under our Contract will be temporarily suspended for the duration of the Event Outside of our Control.

Changes to our Website

YourMoto.Bike Limited reserves the right to change, amend, replace, modify, suspend, add or remove any portions of content available on the website at any time, and can restrict the use and accessibility of the Site as we see fit.

Service Availability

We always strive to provide an unbroken service and availability of our Site and all associated content, but we do not accept responsibility for any consequences of delays or interruptions, for whatever cause. Due to the nature of the internet, we cannot guarantee an unbroken or error-free service.

Your access to our Site may also be occasionally suspended or restricted to allow for essential repairs, maintenance, or for the introduction of new products or services. We will do our utmost to limit the frequency and duration of any such suspension.

Establishing a Link to our Site

You may create a link to our Homepage as long as this is done in such a way that is legal and which does not have any adverse affect on our reputation. You are not permitted under any circumstances to establish a link in such a way that suggests some kind of association, approval, or endorsement on our part where one does not exist.

You must not frame our Site on any other site, nor should a link be established to any other webpage on our Site other than the Homepage, without seeking our prior permission first.

User Feedback

YourMoto.Bike Limited reserve the right to edit, monitor and / or remove content from our Site that we determine in our sole discretion is unlawful, offensive, threatening, obscene, pornographic, defamatory, libellous or otherwise objectionable.

By submitting information to our site, you are solely responsible for all of your comments and their accuracy. YourMoto.Bike Limited will take no responsibility and assume no liability for any comments posted by you or any third party.

Indemnity

You will indemnify us and keep us indemnified against all losses, expenses, costs and liabilities which arise as a result of or in connection with your breach of these Terms & Conditions.

No Warranties Provided

Whilst every effort has been made to ensure the high quality and accuracy of the Site, YourMoto.Bike Limited provide no warranty, whether expressly or implied, of any kind including but not limited to any implied warranties or implied terms of satisfactory quality, fitness for a particular purpose or non-infringement. All such implied terms and warranties are hereby excluded.

Validity

If any part or provision of these Terms & Conditions is found to be unlawful or unenforceable, this shall not affect the validity of any other part or provision of our Terms.

Entire Agreement

These Terms and Conditions, the Guidelines and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these Terms & Conditions.

Jurisdiction

These Terms and Conditions are all governed by English law. We are both in agreement that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Scotland, you may also bring proceedings in Scotland, or if you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland. A Contract for the purchase of Products through our Site and any dispute or claim arising out of or in connection with it will be governed by English law.

Additional Notes and Terms

The contract established by your completion of the ordering process and our acknowledgement of your order is between you and us only. No other person has the right or the ability to enforce any of these Terms. You may only transfer your rights or your obligations under these Terms to a separate person if we agree in to this in writing, prior to the transfer taking place. We have the right to transfer our rights and obligations under a Contract to another organisation should we wish to, but this will not affect your rights or our obligations under the Terms of our agreement with you. We will always notify the consumer of this by way of notification on this page of our Site, should such a transfer take place. Should we fail to insist that you perform any of your obligations under the Terms established here and in all related documents referred to here, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you, and will not mean that you do not have to comply with those obligations in the future. If we do waive a default by you, we will do so in writing, and that will not mean that we will automatically waive any later default by you.
